This Privacy Policy explains how Assist collects, uses, shares, and protects personal information, including when you use our CRM platform, visit our website, request a demo, or opt in to receive text (SMS) or email communications from us. It is incorporated by reference into our Terms of Service.

1. Scope of This Policy

This Policy applies to personal information Assist collects through theassistcrm.com, our demo scheduling and lead forms, our CRM product and related applications (the “Service”), and our marketing communications, including SMS/text messages and email. It applies to visitors, prospective customers (“leads”), and customers of the Service. It does not apply to information our customers collect from their own clients and contacts using the Service; that data is “Customer Content” governed by our Terms of Service, and our customers are responsible for their own privacy practices toward their contacts.

2. Information We Collect

A. Information You Provide to Us

  • Contact details: name, email address, phone number, company or brokerage name, and any information submitted through a demo request, sign-up, or contact form.
  • Account and billing information if you become a customer of the Service.
  • Communications: messages you send us by email, chat, or SMS, including replies to marketing texts.

B. Information Collected Automatically

  • Device and usage data: IP address, browser type, pages viewed, referring URLs, and general location, collected through cookies and similar technologies when you visit our website or use the Service.
  • Engagement data: whether you opened an email, clicked a link, or responded to a text message.

C. Calendar Data

  • If you connect your Google Calendar, we collect the metadata necessary to manage meeting scheduling and sync events (for example, event times and attendees). We do not access calendar content beyond what is needed for this purpose.

D. Location Data

  • When you use location-based features, such as maps or address lookup, we may collect and process geolocation information.

E. Authentication Tokens

  • OAuth tokens used to securely authenticate your account with integrated services, such as Google Workspace APIs. We do not store your third-party passwords.

F. Information From Third Parties

We may receive limited information about you from marketing, forms, and scheduling platforms we use to operate our website and demo process (see Section 6, “Third-Party Service Providers”).

3. SMS / Text Messaging Program

If you opt in to receive text messages from Assist (for example, demo reminders or marketing texts), the following terms apply in addition to the rest of this Policy:

  • Consent. By checking the applicable box and submitting your phone number, you consent to receive the category of message you selected (for example, appointment/demo reminders or marketing SMS) at the number provided. Consent to receive texts is not a condition of any purchase.
  • Message Frequency and Cost. Message frequency varies depending on your interactions with us (for example, upcoming demos). Message and data rates may apply.
  • Opt-Out and Help. Reply STOP at any time to opt out of further text messages, or reply HELP for assistance. After you opt out, we will send a one-time confirmation and will not send further messages unless you opt back in.
  • Carriers. Carriers are not liable for delayed or undelivered messages.

No sharing of SMS opt-in data. No mobile information collected in connection with our SMS program (including phone numbers and consent status) will be shared with third parties or affiliates for their own marketing or promotional purposes. This restriction does not apply to our service providers who process this data on our behalf solely to deliver the Service and the messages you requested (see Section 6).

4. How We Use Information

  • To provide, operate, and improve the Assist platform and website.
  • To authenticate user accounts and manage secure access.
  • To enable key features such as meeting scheduling, lead management, and calendar syncing.
  • To schedule, confirm, and remind you of demos and other appointments you request.
  • To send marketing communications by email or SMS, where you have opted in or as otherwise permitted by law, and to honor your opt-out requests.
  • To respond to inquiries and provide customer support.
  • To detect, prevent, and address fraud, security, or technical issues.
  • To comply with legal obligations and enforce our agreements.

We do not sell or rent your personal data under any circumstances.

5. Use of Google Workspace APIs

Assist integrates with Google APIs to deliver functionality such as login with Google, calendar synchronization, and address mapping using Google Maps. We access only the minimum data necessary to perform these functions.

We do not use any data obtained from Google Workspace APIs, including Gmail, Google Calendar, and Google Drive, to develop, improve, or train generalized AI or machine learning models.

This data is processed only within the context of the Assist platform to fulfill user-facing features and is not shared with third parties except as outlined in Section 6.

6. Third-Party Service Providers

We use third-party vendors to operate our website and platform, manage leads, and deliver communications, including SMS and email. These vendors process personal information on our behalf under their own security and confidentiality obligations, and only for the purposes described in this Policy. As of the effective date above, these include:

  • HubSpot – form submissions, lead and demo scheduling management, and marketing communications, including SMS demo reminders sent through HubSpot’s SMS tool.
  • Twilio – underlying SMS delivery provider for HubSpot’s SMS tool. Twilio transmits message content and phone numbers on HubSpot’s behalf; Assist does not hold or manage a separate carrier account.
  • Omnisend – subscriber email communications.
  • ChartMogul – subscription and billing analytics.
  • Stripe – payment processing for customer subscriptions.
  • Zoom – hosting demo calls and other scheduled meetings.
  • Vercel – website and application hosting.
  • Analytics and advertising tools – including tracking pixels and analytics services used on our marketing pages and within the platform, to understand usage and measure marketing performance.
  • Other categories of service providers, including professional services advisors, security and fraud-prevention providers, corporate IT services, and any other suppliers, sub-contractors, partners, or vendors acting on our behalf to support our operations.

We may also share personal data with government authorities or legal entities when required to comply with legal obligations. Our platform may contain links or integrations with other third-party services that operate under their own privacy policies; we encourage you to review those separately and are not responsible for their practices.

We do not sell personal information to third parties. We do not share SMS opt-in consent or phone numbers with any third party for that third party’s own marketing purposes. Your data will never be disclosed for marketing or advertising purposes without your explicit consent.

7. Legal Bases and Your Choices

  • Opt-out of marketing SMS: reply STOP to any text, or email [email protected].
  • Opt-out of marketing email: use the unsubscribe link in any marketing email, or email [email protected].
  • Access, correction, or deletion: you may request access to, correction of, or deletion of your personal information by emailing [email protected]. We will respond within a reasonable time and as required by applicable law.
  • Withdraw consent for processing where applicable, and revoke Google API access at any time through your Google account settings.
  • Do Not Sell/Share: Assist does not sell personal information. If you are a California resident, you have the right to opt out of any “sharing” of personal information for cross-context behavioral advertising, to the extent applicable; contact us to exercise this right.
  • We will not discriminate against you for exercising any privacy rights available to you under applicable law.

8. Cookies and Tracking Technologies

Our website and platform use cookies and similar technologies to remember preferences, understand usage, and support marketing and lead-generation tools such as our forms and scheduling widgets. You can control cookies through your browser settings; disabling cookies may affect site or platform functionality.

9. Data Retention

We retain personal information for as long as needed to provide the Service, fulfill the purposes described in this Policy, and comply with legal, accounting, or reporting obligations. Lead and demo-scheduling information for individuals who do not become customers is retained only as long as reasonably necessary for follow-up and compliance purposes, after which it is deleted or de-identified. You may request account deletion at any time by contacting us.

10. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information appropriate to our Service, including data encryption, secure access controls, and regular system monitoring. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

11. Children’s Privacy

The Service and our website are not directed to children under 13, and we do not knowingly collect personal information from them. If we learn we have collected personal information from a child under 13, we will delete it.

12. Fair Housing and Professional Use

Assist is a productivity and CRM tool for licensed U.S. real estate professionals. This Policy governs Assist’s own collection and use of personal information; it does not govern how our customers collect, use, or message their own leads and clients, which remains each customer’s responsibility, including compliance with Fair Housing, TCPA/CTIA, CAN-SPAM, and other applicable laws.

13. Changes to This Policy

We may update this Policy from time to time. Changes will be posted on this page with a revised “Effective Date” above. For material changes, we will provide reasonable notice, such as posting a notice on our website or emailing registered users, before the change takes effect.
